New Innovations provides this List Server application (“List Server”) to you under the terms and conditions of use below and your use of the List Server constitutes your acceptance of these terms and conditions, which you acknowledge may change from time to time:
1. Users. New Innovations provides this List Server only to licensed, administrative level users of its RMS software (“RMS”). Unauthorized users are strictly prohibited.
2. Content. Information posted is restricted to the discussion of topics related to the use of RMS. New Innovations is not responsible for the views, opinions and recommendations posted here by users of the List Server and does not support or endorse such views, opinions, and recommendations. We reserve the right to monitor and censor all postings. New Innovations does not represent the accuracy of information found within the List Server. You are solely responsible for the information posted by you on the List Server. You acknowledge and agree that any personal information you post about yourself (including email address) may be visible to other List Server users. Any information you provide will be non-confidential and you grant New Innovations a royalty free, irrevocable, worldwide license to use, copy, distribute, sublicense, display, perform, and prepare derivative works from such information.
3. Your Conduct. You agree not to post: (a) unlawful, vulgar, or obscene information of any kind, (b) any chain emails, junk emails, spam, other mass communications, viruses, or other destructive files, and/or (c) any information which violates the intellectual property or other rights of New Innovations or other users of the List Server. You further agree that you will not use the List Server for commercial or advertising purposes and will not make anonymous postings.
4. Termination. You acknowledge that New Innovations may in its sole discretion revise, suspend, or terminate your subscription to the List Server or discontinue the List Server itself at any time for any reason without prior notice and without any liability to you. You may terminate your subscription at any time by sending New Innovations an email communication.

ALL INFORMATION AVAILABLE TO YOU THROUGH THE LIST SERVER IS PROVIDED “AS IS” AND NEITHER NEW INNOVATIONS NOR ITS AFFILIATES MAKES ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO THE ACCURACY OR RELIABILITY OF SUCH INFORMATION OR WITH RESPECT TO THE LIST SERVER (INCLUDING WITHOUT LIMITATION ITS ACCESSIBILITY), EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INTERFERENCE AND/OR NON-INFRINGEMENT.
IN NO EVENT WILL EITHER NEW INNOVATIONS OR ITS AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS OR DATA), EVEN IF YOU OR THIRD PARTIES HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.
The List Server does not replace the normal request for assistance features of RMS and should not be used to report problems or ask for the assistance of New Innovations.
6. Other Terms and Conditions. The standard terms and conditions of use for the web site of New Innovations are incorporated into these terms and conditions by reference as if they were fully written in these terms and conditions. Your continued use of the List Server constitutes your acceptance of any changes made to these terms and conditions from time to time by New Innovations.
